Terms and Conditions for Portrait Commissions.

1. General Terms
• Artist: Kerry Rigby
• Client: The individual or entity commissioning the portrait.
• Portrait: A custom-made artwork depicting the client's pet, loved one or wildlife.
• Commission: The agreement between the Artist and Client for the creation of the Portrait.

2. Commission Process
• Initial Contact: The Client contacts the Artist to express interest in a commission.
• Consultation: The Artist and Client discuss the timescale, desired style, medium, and details of the Portrait. Photos sent by email are preferred, but if you send hard copies by post, I advise you not to send your only copies as although they will be looked after and returned, I cannot guarantee the safety of your property.
• Deposit: The Client pays a non-refundable £30 deposit to secure the commission.
• Creation: The Artist begins work on the Portrait when stated.
• Completion: The Portrait is completed and presented to the Client.
• Final Payment: The Client pays the remaining balance of the commission fee.

3. Pricing and Payment
• Pricing: The price of the commission is determined based on factors such as the size, complexity, and medium used.
• Payment: The Client pays a non-refundable deposit upon confirming the commission. The remaining balance is due upon completion of the Portrait. Payments can be made by bank transfer or cash.
• Late Payments: If the Client fails to pay the remaining balance within 14 days of the Portrait's completion, the Artist may charge a late fee or interest.

4. Revisions and Changes
• Revisions: The Artist will make reasonable revisions to the Portrait based on the Client's feedback during the creation process if desired.
• Major Changes: Major changes requested after the Portrait is substantially complete may result in additional fees or delays if it is possible to make further changes.

5. Delivery and Ownership
• Delivery: The Artist will deliver the Portrait to the Client or arrange for shipping at the Client's expense. Post & packing costs are not included in the prices for animal portrait commissions, this varies according to delivery method, and whether the painting is framed or not.
• Ownership: Upon full payment, the Client becomes the owner of the Original Portrait. I keep a digital image of each finished artwork for reference, and this may also be used for future promotion and publicity purposes possibly with the name of the animal. However, please let me know at the time of booking if you would prefer me not to use the image in any publicity and I will not do so.

6. Copyright
• Copyright: The Artist retains copyright ownership of the Portrait. The Client is granted a limited license to reproduce the Portrait for personal use.
• Commercial Use: The Client may not use the Portrait for commercial purposes without obtaining written permission from the Artist.

7. Cancellation
• Cancellation: The Client may cancel the commission by providing written notice to the Artist within 14 days of confirming the commission unless the portrait process has begun.
• Refund: The Client will receive a refund of the deposit minus any costs incurred by the Artist.

8. Limitation of Liability
• Liability: The Artist is not liable for any damages or losses arising from the commission, including but not limited to errors, omissions, or delays.
• Damaged artwork:  Every effort is taken to ensure your portrait arrives safely and on time. Please open and check your order upon receipt and report any damages within 3 days. In the unlikely event your portrait arrives damaged please contact me within 3 days of receipt. Please take photos of the damage. Please return the item/s in the original packaging within 7 days of receipt and I will fix or replace your portrait. It is important to return your order by a tracked service as we cannot be held responsible for any items lost in transit.

Artist’s Copyright

I retain the copyright and reproduction rights of all my work (in keeping with the law on Artists Copyright). However for pet portraits, because the animal is so personal to you, I would not normally have a problem with you using the image again for your own personal use, but excluding any use for commercial purposes.

All images on this website are Copyright Kerry Rigby 2021 - 2024. All rights reserved. This includes commissioned artwork. Artwork on this website is protected by international copyright law and no image may be used or copied for any commercial or non-commercial purposes without prior written permission from the artist.

Gift Voucher Terms and & Conditions

 

1. Gift Vouchers are valid for 12 months after purchase, except in exceptional circumstances.

2. Once a Gift Voucher is redeemed by the recipient, the portrait will be slotted into my current wait list.

3. Once purchased, Vouchers are non refundable, unless agreed by the artist at the time purchase and for exceptional reasons only. Vouchers cannot be exchanged for money. Vouchers can be exchanged for prints, or any original artwork I may have in stock at the time or purchaser may re-gift the voucher if the recipient cannot supply adequate photos or doesn’t want a portrait.

 

At all time customer satisfaction is my ultimate priority and I will work with you to make sure you are happy with your purchase.

 

Terms and Conditions for Purchased Original Artwork.

Artist: Kerry Rigby*

Client: The individual or entity purchasing the Original Artwork.*

1. Delivery & Ownership: The Artist will deliver the Portrait to the Client or arrange for shipping at the Client's expense. Post & packing costs are not included in the prices unless stated otherwise. This varies according to delivery method, and whether the painting / drawing is framed or not. Ownership: Upon full payment, the Client becomes the owner of the Original Portrait. I keep a digital image of each finished artwork for reference, and this may also be used for future promotion, publicity purposes and producing prints for resale.

 

2. Copyright: The Artist retains copyright ownership of the original artwork. Commercial Use: The Client may not use the artwork for commercial purposes without obtaining written permission from the Artist.

3. Cancellation: The Client cannot cancel an order of original artwork once shipped.

4. Refund: If the original artwork has not been shipped the Client will receive a refund minus any costs incurred by the Artist if any.

5. Limitation of Liability* Liability: The Artist is not liable for any damages or losses arising from the commission, including but not limited to errors, omissions, or delays.*

6. Damaged artwork:  Every effort is taken to ensure your portrait arrives safely and on time. Please open and check your order upon receipt and report any damages within 3 days. In the unlikely event your artwork arrives damaged please contact me within 3 days of receipt. Please take photos of the damage. Please return the item/s in the original packaging within 7 days of receipt and I will fix or replace your portrait if possible; alternatively a refund will be given minus any costs incurred if any. It is important to return your order by a tracked service as we cannot be held responsible for any items lost in transit.
